Diabetic Patient Claims Malpractice After Waiting 11.5 Hours for Emergency Medical Treatment
An emergency-room patient who alleges he received no care after a triage nurse prioritized him as “non-urgent” and failed to include his history of diabetes or diabetic ketoacidosis condition, has stated a claim for violation of the Emergency Medical Treatment and Active Labor Act, a Danville U.S. District Court says.
State has news about DNA, can’t find felons to tell
State officials trying to notify hundreds of felons that their case files contain newly discovered, but decades-old DNA evidence that could exonerate them are having a hard time finding many of the convicts.
The problems prompted the Virginia State Crime Commission last week to order a team to study better ways of notifying more than 1,000 felons who committed certain crimes from 1973 through 1988. Last month, letters were sent to nearly 400 felons, but officials were still searching for addresses for the rest.
Of the letters that were mailed, 23 percent of the felons acknowledged receiving them, Shawn Armbrust, executive director of the Mid-Atlantic Innocence Project, told the commission. Another 15 percent were returned by the postal service, she said.
Teen charged with attempted capital murder of Va. Beach police officer
VIRGINIA BEACH – An 18-year-old is charged with trying to kill a police officer. Justin Patriquin is due to be arraigned Friday afternoon on charges of attempted capital murder and use of a firearm, according to online court records. Police say he fired shots when the car he was in was stopped around 1:30 a.m. October 5 on suspicion of reckless driving.
Va. man charged with sexual abuse of coma patient
CHESAPEAKE, Va. (AP) – A 48-year-old Chesapeake man has been indicted on a charge of aggravated sexual battery in the sexual abuse of a comatose female patient at a nursing home. Mark Albright is accused of the abuse of a patient at Chesapeake Health and Rehabilitation Center, where he was employed as a licensed practical nurse. A police affidavit filed in Chesapeake Circuit Court shows an employee entered the room of a 43-year-old patient to conduct nightly medical duties and allegedly observed Albright with his mouth on the woman’s breast.
Man who put boy in trunk after crash pleads guilty
CULPEPER, VA - The man who put the body of a young boy in his trunk after a crash faces sentencing in November. Fielding Kines, 38, pled guilty to involuntary DUI manslaughter Wednesday in Culpeper. The charges stem from a crash last May that killed the eight-year-old son of Kines’ girlfriend. Authorities say Kines was drunk when he wrecked. Then, put the boy’s body in the trunk.
Judge rules in favor of breakaway congregations
A Fairfax County judge dealt the Episcopal Church and the Diocese of Virginia a third defeat in their efforts to retain millions of dollars of church property being held by 11 breakaway congregation. On Tuesday, Circuit Judge Randy I. Bellows ruled on whether the U.S. Constitution’s contracts clause applies to the case and whether the breakaway churches had the right to invoke what’s been termed the “division statute,” an 1867 law that allows a majority of a breakaway church to retain the property.
